Re: East County Water Control District –
Amended Water Control Plan for Unit of Development No. 5, as amended
The East County Water Control District, “ECWCD”, located in Lehigh
Acres and Hendry County, is a “Special District”, governed by Florida State
Statute and is responsible for providing water management services for property
within its boundaries of which you are a landowner. The District maintains 311 miles of canals, 20 lakes, 1298
preserve acres, 360 culvert crossings, 22 bridges and 66 water control
structures which are contained in the “Water Control Plan”.
ECWCD is required to review and update its
“Water Control Plan” every five (5) years, and to the extent necessary, amend
the Plan. The Amended Water Control
Plan lists the proposed repairs, maintenance and updates for the canals, lakes,
preserves, culvert crossings, bridges and water control structures along with
the additional proposed improvements.
The Notice on the reverse side of this letter is provided to
inform you that the Board of Supervisors of the ECWCD has determined to go
forward with consideration of the Amended Water Control Plan for Unit of
Development No. 5, as amended, to provide for the further development of the
District’s water management facilities and to implement the District’s
2008-2012 Proposed Projects.
The date, time and place of the
Public Hearing on this matter is January 28, 2008, at 6:30 P.M. at the Majestic
Golf Club located at 350 Homestead Road S., Lehigh Acres, Florida 33936.
The purpose of the Public Hearing is
to receive public comment on whether the District should proceed with the
adoption of the proposed Amended Water Control Plan for Unit of Development No.
5, as amended.

proceeding or desire to review the materials upon which the Board of
Supervisors will rely to make a decision, you may contact the District at (239)

NOTICE OF PUBLIC HEARING
TO
THE OWNERS AND ALL PERSONS INTERESTED IN THE LANDS, CORPORATE AND OTHER
PROPERTY IN AND ADJACENT TO THE EAST COUNTY WATER CONTROL DISTRICT’S UNIT OF
DEVELOPMENT NO. 5, AS AMENDED.
You are notified that the East
County Water Control District has filed in the office of the Secretary of the
District a Resolution to consider approval of a water control plan or amendment
to its current water control plan for the District’s Unit of Development No. 5,
as amended, to review and update the Plan every five (5) years in accordance
with Chapter 298.225(7), F.S., and to implement the District’s 2008-2012
Proposed Projects including the following:
Replace Existing Water Control Structures; Replace Existing Canal
Culvert Crossings; Harn’s Marsh Improvements; New Structures in Southwest
District; Jim Fleming Ecological Park; Design and Construct District
Headquarters; Dog to Hendry Connection; West Marsh; Greenbriar Improvements;
Continuation of ELCARP; Restore Flow South of SR 82; Sailfish Canal Greenway;
Land Acquisition – Greenrbiar Storage; Land Acquisition – Hendry Storage;
Homestead Water Control Structures; Harn’s Marsh Regional Park. On or before
its scheduled meeting of January 28, 2008 at 6:30 p.m. at Majestic Golf Club,
350 Homestead Road S., Lehigh Acres, Florida, written objections to the
proposed plan or plan amendment may be filed at the District’s offices. A
Public Hearing on the proposed plan or plan amendment will be conducted at the
scheduled meeting and written objections will be considered at that time. At
the conclusion of the hearing, the Board of Supervisors may determine to
proceed with the process for approval of the proposed plan or plan amendment and
direct the District Engineer to prepare an Engineer’s Report identifying any
property to be taken, determining benefits and damages, and estimating the cost
of implementing the improvements associated with the proposed plan or plan
amendment. A final hearing on approval of the proposed plan or plan amendment
and Engineer’s Report shall be duly noticed and held at a regularly scheduled
Board of Supervisors’ Meeting within sixty (60) days after filing of the
Engineer’s Report with the Secretary of the District.
If a person decides to
appeal the decision of the Board of Supervisors with respect to any matter
considered at the public hearing herein referred, he or she may need to ensure
that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is based.
